Hon'ble Shri Justice Arvind Singh Chandel Order on Board 17.08.2020

1. This is the fourth bail application submitted by the Applicant under Section 439 of Cr. P.C.

2. First bail application of the Applicant was dismissed as not pressed vide order dated 10.01.2019 passed in MCRC No.8051/2018.

3. Second bail application was dismissed with liberty to file a fresh after examination of the mother and sister of the deceased vide order dated 15.02.2019 passed in MCRC No.753/2019.

4. Third bail application was dismissed as withdrawn vide order dated 30.09.2019 passed in MCRC No.6247/2019.

5. Counsel for the Applicant submits that Applicant is in jail since 13.07.2018 and Trial is still going on, therefore, he prays that the Applicant may be granted benefit of bail.

6. Counsel for the State submits that only one witness is to be examined.

7. Considering the above submission made by counsel for the parties, Trial Court is directed to expedite the matter and decide the same as early as possible preferably, within two months from today.

8. A liberty is granted in favour of the Applicant to move an application for grant of regular bail if Trial is not concluded within two months.

9. Accordingly, the instant application is dismissed with the aforesaid liberty.
