1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.757/2017, registered at Police Station Civil Lines, Bilaspur, for the offence punishable under Sections 379, 380 of the IPC and Section 41 (1+4) of the CrPC.

2. Learned counsel for the applicant seeks to withdraw this application with liberty to file afresh with correct crime number

3. The application is dismissed as withdrawn with liberty aforesaid.

4. Certified copy of the impugned bail rejection order be returned to counsel for the applicant on his duly furnishing a Photostat copy of the same.
