1. Learned counsel for the petitioner would submit that the petitioner was imposed with a punishment of stoppage of one increment with cumulative effect by Commissioner Municipal Corporation Durg (Respondent No. 3). It is stated that against such inflictment of punishment the petitioner has preferred a Departmental Appeal before Respondent No. 2 (Annexure P-4). The only prayer made by the petitioner is that Respondent No. 2 may be directed to decide the departmental appeal within reasonable time.

2. Perusal of Annexure P-4, would show that the reference is made to the Director Urban Administration against the order of punishment inflicted. In the prayer it is stated that the petitioner have not been given proper opportunity of hearing and other grounds have been raised.

3. Considering the same, though Annexure P-4 is filed the petitioner is given liberty to make a fresh constituted appeal to Respondent No.2 within a period of 3 weeks from today, in such case if the appeal is filed before Respondent No. 2, the same shall be decided within a further period of 4 months from the date of receipt of a copy of this order. The petitioner is given liberty to attach a copy of Annexure P-4 along with such appeal to raise additional grounds therein.
