We have considered the reasons stated for the delay. We are satisfied that sufficient cause has been shown. Delay is condoned. Heard on application for grant of leave to appeal under Section 378(3) of the Code of Criminal Procedure.

The Applicant/State is exempted from curing the defect. The matter is treated as ripe.

Accordingly, leave to appeal as prayed for, is granted. Registry is directed to register regular acquittal appeal. After registration of the regular acquittal appeal, issue notice to the Respondents, on payment of process fee, as per rules. Call for records.
