1. The petitioner has filed this writ petition against the order dated 5.2.2018 passed by respondent No.2/Sub-Divisional Officer, Bilaigarh under Section 40 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993.

2. Learned Panel Lawyer for respondents No.1 and 2/State would submit that the order is appealable before the Collector,

Balodabazar.

3. Be that as it may, the petitioner is at liberty to prefer an appeal before the concerned Collector within a period of 10 days from today. If such an appeal is preferred, the concerned Collector shall consider and decide the same within a period of two months from its receipt after hearing all affected parties.

4. With the aforesaid observation, the writ petition finally stands disposed of. No cost(s).
