NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WRIT PETITION (C) NO. 793 OF 2020 • Badruddin Khan, S/o Late Shri Roshan Khan, aged about 42 years, R/o Main Road, near Jait Khambh, Bajrang Chowk, Talapara, Bilaspur, Tahsil & District Bilaspur (CG).

... Petitioner versus 1.

The Registrar, Firms and Society Registration, 3rd Floor, Indrawati Bhawan, New Raipur, District Raipur (CG) 2.

Superintendent of Police, Bilaspur, Tahsil & District Bilaspur (CG) ... Respondents For Petitioner :

Mr. Badruddin Khan, Petitioner in Person.

For Respondents :

Mr. Anmol Sharma, Panel Lawyer.

Hon'ble Shri Justice P. Sam Koshy Order on Board /03/2020 1.

The relief sought for by the Petitioner in the present Writ Petition is for an appropriate direction to Respondent No.1 to provide the requirements under law for registration of a Society on a letter with seal and signature of Respondent No.1, with which the Petitioner could complete the requisite formalities. 2.

According to the Petitioner, when he approached the Respondent No.1, the Respondent No.1 issued a letter showing certain formalities to be completed; one of such formalities is of getting a NOC from the Respondent No.2. The Respondent No.2 seems to have expressed his reluctance on account of the letter of Respondent No.1 not bearing the seal and signature from the office of Respondent No.1. The Petitioner submits that except for NOC from the office of Respondent No.2, he has completed all the other requisite formalities. 3.

So far as the completion of formality of NOC from the office of Respondent No.2 is concerned, let Respondent No.1 issue a letter to the Petitioner in this regard under the seal and signature of Respondent No.1, which may be presented by the Petitioner to Respondent No.2 based upon which the Respondent No.2 may issue a requisite NOC. Respondent No.1 may also consider whether the NOC from Respondent No.2 is required at all for registration of the Society or not.

4.

Accordingly, let appropriate steps be taken by the Respondents on an application moved by the Petitioner promptly at the earliest. Sd/- (P. Sam Koshy) /sharad/ JUDGE
