1. On due consideration delay of 06 days in filing of the Cr.M.P. is condoned. Accordingly, I.A. No.01/2020, for condonation of delay is allowed.
2. The trial Court has acquitted the accused of the charge under Section 436 of the IPC.
3. Accused allegedly committed mischief by setting ablaze the shop belonging to PW-6 Budhar Lodhi, however, the said
CRMP No. 573 of 2020 witness has turned hostile and has not supported the case of the prosecution. Even Rakesh Yadav PW-1 who has informed PW-6 Budhar Lodhi about the incident has not supported the case of prosecution.
4. No case for grant of leave to appeal is made out.
5. Accordingly, the Cr.M.P. deserves to be and is hereby dismissed.
