1. This writ petition is directed against the order dated 4-4-2003 imposing punishment of dismissal from service.
2. During the pendency of writ petition, on 1-2-2006, this Court has given liberty to the petitioner to make representation / appeal to the respondents and directed the respondents to consider the same in accordance with law. Representation was preferred by the petitioner to the Chairman of the respondent Bank, but that has been dismissed on the ground that the Board of Directors of the Bank is the competent authority to entertain the appeal. Since the impugned order of dismissal is appealable and representation preferred has already been dismissed on the ground of Board of Directors being the competent authority, it would be appropriate to relegate the petitioner to the remedy of appeal before the Board of Directors of the newly formed respondent Bank which is known as the Chhattisgarh Rajya Gramin
Bank, as respondent No.1 Bank has already merged to the said Chhattisgarh Rajya Gramin Bank, within 30 days from today, and if appeal is preferred within that period as writ petition remained pending since 3-9-2002, the newly formed Bank shall consider and dispose of the same after hearing the petitioner within four months from the date of receipt of appeal. Ordered accordingly. The petitioner is at liberty to raise all legally permissible grounds which shall be considered by the respondent Bank.
