1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.234/2019, registered at Police Station Somni, District Rajnandgaon C.G. for offences punishable under Section 11(द) of the Prevention of Cruelty to Animals Act, 1960 and Section 10 of the Chhattisgarh Krishak Pashu Parirakshan Adhiniyam.
2. The applicant is sought to be arrested on the basis of the memorandum of co-accused - Raju Pal who was driving the
MCRCA No. 332 of 2020 subject vehicle in which 16 cattle i.e. 12 cows, 3 buffaloes and one calf were smuggled to Nagpur.
3. Learned State counsel would oppose the prayer for grant of anticipatory bail.
4. Considering that the applicant was not present on the spot and his name appears in the memorandum statement of the co-accused, this Court is inclined to extend the benefit of anticipatory bail.
5. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (I) he shall make himself available for interrogation by a police officer as and when required;
(ii) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
