(2) The petitioner is aggrieved by cancellation of his appointment on the post of Shiksha Karmi Grade-III on the ground that despite repeated opportunities, he failed to produce duly verified caste status certificate. (3) On submission of learned counsel for the petitioner that the petitioner's application for verification of caste status is pending before

the High Power Caste Scrutiny Committee, this Court, on the last date of hearing, had directed learned State counsel to verify the present status of the application.

(4) Learned counsel for the State would show to this Court a communication dated 24.09.2015 issued from the O/o Dy. Director, High Power Caste Scrutiny Committee, Raipur and the District Research OfÏcer, Tribal Research and Training Institute, Regional OfÏce, Jagdalpur, to submit that the petitioner has never moved any application for scrutiny of his caste status. (5) At this stage, learned counsel for the petitioner would submit that the petitioner may be granted liberty to move appropriate application for verification of his caste status and thereafter, to move afresh depending upon the outcome of his application. (5) Learned counsel for the State has no objection.

(6) In view of the above, the writ petition is disposed of with a direction that in the event, the petitioner moves an application before the High Power Caste Scrutiny Committee, Raipur, for verification of his caste status within a period of one month from today, the said authority shall decide the application on its own merits at the earliest, preferably within a period of 3 months from the date of its receipt. Depending upon the outcome of the verification, the petitioner would be at liberty to move afresh before this Court.
