The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.563/2019, registered at Police Station Abhanpur, District Raipur for the offence punishable under Section 302 of IPC.

The applicant has allegedly committed murder of his wife Tarpana Sahu by strangulating her in the late evening/night of 31.10.2019. 3.

There being no eye witness, the charge sheet is based on the memorandum statement and consequent recovery of jeans pant belonging to the applicant.

In addition, the applicant has falsely stated before the Police by lodging merg intimation that some unknown miscreants have assaulted him and his wife Tarpana.

Learned State counsel would oppose the prayer for grant of bail. 6.

Considering the quality of evidence and for the fact that the applicant is in jail since 01.11.2019 and the investigation is already complete, this Court is inclined to release the applicant on bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
