Challenge in the present Writ Petition is to the Order dated 1.5.2015 (Annexure P-1) whereby the Respondent No.1-University had rejected the request of the Petitioner for grant of two (2) grace marks. 2.
At the outset, this Court is of the opinion that the present Writ Petition suffers from inordinate delay and laches. The impugned Order is one which was passed as early as on 1.5.2015 and the present Writ Petition is being filed after more than five years, i.e., on 19.2.2020. No plausible explanation has been given by the Petitioner for the delay in the filing of the present Writ Petition except for a bald submission of the Petitioner being not well during these period. Another reason for not entertaining the present Writ Petition is the fact that the Petitioner meanwhile appears to have superannuated from the service which otherwise means that as long as he was in service he did not raise any objection and accepted the same and as soon as he retired from the service he is trying to get the benefits which he did not raise, claim or question at the appropriate time. 3.
The Writ Petition accordingly stands dismissed only on the ground of delay and laches.
