1. The claim of the petitioner is that the petitioner though was found to be entitled for the first and second time bound pay scale and having not been granted, recommendation was made by the District Education Officer, Kabeerdham by communication dated 08.11.2017 (Annexure P-4). In the meanwhile, the petitioner was superannuated on 31.07.2019 but the benefit of time bound pay scale which still have an effect to the retiral benefit granted to the petitioner has not been given.

2. Perusal of Annexure P-4 would show that the communication was made by the District Education Officer, Kabeerdham dated 08.11.2017, which purports that the petitioner is entitled for second time bound pay

scale which has not been granted and recommendation was made to grant the time bound pay scale to the petitioner. The contents of Annexure P-4 therefore would show that the petitioner was held to be entitled for the time bound pay scale and unfortunately since the petitioner had retired before it being granted on 31.07.2019, it is directed that the respondent No.2, Director, Public Instructions, shall act according to the communication Annexure P-4 dated 08.11.2017 wherein the petitioner was held to be entitled for two time bound pay scale and the necessary benefit which shall accrue to the petitioner shall granted to him. Since the petitioner stands retired, the decision to the above communication shall be made within a period of 90 days from the date of receipt of a copy of this order. The petitioner shall also be at liberty to place this order along with the copy of Annexure P-4 to the respondent No.2 within a week.
