1. On due consideration delay of 97 days in filing of the Cr.M.P. is condoned. Accordingly, I.A. No.01/2020, application for condonation of delay is allowed.
2. The trial Court has acquitted the accused of the charges under Sections 363, 366-A and 376 (2) (ढ) of the IPC and in
CRMP No. 579 of 2020 alternative Section 6 of the Protection of Children from Sexual Offences Act, 2012.
3. Accused allegedly abducted the prosecutrix and committed forcible sexual intercourse by making her to stay at his own house and thereafter in the house of his elder sister.
4. Prosecutrix examined as PW-1 has turned hostile and has not supported the prosecution. As per her statement, she has been married with some other boy in April, 2017.
5. Considering the evidence adduced by the prosecution in its entirety, no case for grant of leave to appeal is made out.
6. Accordingly, the Cr.M.P. deserves to be and is hereby dismissed.
