(1) Learned counsel appearing for the petitioner would submit that pursuant to the direction of Supreme Court in Civil Appeal Nos.52-63/98 passed in the matter of Union of India Vs. Supreme Steels & General Mills & Ors., the petitioner has made application for payment of excise duty on 16.09.1999, which has not been considered and decided till this date. (2) Be that as it may, respondent No.2 is directed to consider and take a decision on the pending representation and the subsequent representations of the petitioners in the light of

decision of Supreme Court in the matter of Union of India (supra) expeditiously preferably within a period of 45 days from the date of receipt/production of copy of this order.

(3) With the aforesaid observation, the writ petition stands finally disposed of.
