Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 19/05/2016 The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 163/2016, registered in Police Station Jamul, District : Durg for the offence punishable under Section 354 IPC and Section 8 & 12 of the POCSO Act.

Although the prosecution alleges that the applicant outraged the modesty of the prosecutrix aged about 13 years, when he had gone for doing some repairing work in the house of the prosecutrix, while examined in the court, the prosecutrix diluted the prosecution case to a great extent. 3.
Counsel for the State would oppose the bail application. 4.
Considering the fact that the applicant is in jail since 07.03.2016, prosecutrix having already been examined and that there is no possibility of applicant influencing the case of prosecution, this Court is inclined to release the applicant on bail. Accordingly, the bail application is allowed. It is directed that in the event of the applicant's executing a personal bond for a sum of Rs.
25,000/- with one surety for the like amount to the satisfaction of the trial Court, he shall be released on bail. He shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. Sd/- Prashant Kumar Mishra Vacation Judge suguna
