Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 19/05/2016

1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.51/2016, registered at Police Station Malkharoda, Distt. Janjgir-Champa, for the offence punishable under Sections 420, 409, 511 read with Section 34 of the IPC and Section 5(a)(b)(c) of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978.

2. Case of the prosecution, in brief, is that the applicant along with two other accused persons namely Sagaf Jafar and Saiyyad Ansari @ Shahid Aalam have extracted Rs.480/- from the complainant promising to deliver him washing machine, motorcycle etc., upon draw of lottery. Later-on, neither the draw was held not the articles were handed-over to the complainant and the witnesses, who were also cheated.

3. Co-accused persons Sagaf Jafar and Saiyyad Ansari @ Shahid Aalam have already been released on bail by a coordinate Bench of this Court in M.Cr.C.Nos.2066/2016 and 2160/2016, respectively, vide order dated 18-4-2016.

4. For the foregoing, this Court is inclined to grant bail to the applicant.

Accordingly, the bail application is allowed.

5. It is directed that in the event of applicant's executing a personal bond for a sum of Rs.25,000/- with two sureties for the like amount to the satisfaction of the trial Court concerned, he shall be released on bail. He is directed to appear before the trial Court on each and every date given by the said Court.
