Proceedings through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 18/06/2020

1. The applicants have preferred this application for grant of anticipatory bail, as they apprehend their arrest in connection with Crime No.45/2020, registered at Police Station Saraipali, District Mahasamund C.G. for offence punishable under Section 304(B)/34 of the IPC.

2. Applicants are the sisters of the husband of the deceased. The marriage took place in the year 2016. It is alleged that the deceased was ill treated in connection with demand of dowry for which she committed suicide by consuming insecticides on 31.08.2019. Allegation against the present applicants, who are unmarried sisters of the husband of the deceased, is that they too were involved in passing on sarcastic comments criticizing the quality of articles brought in dowry.

3. Learned State counsel would oppose the prayer for grant of anticipatory bail.

4. Considering the facts situation of the case and particularly considering the fact that the applicants are unmarried sisters of the husband of the deceased and also considering the fact that the allegations against them are omnibus in nature, this Court is inclined to grant anticipatory bail to the applicants.

5. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicants, they shall be released on anticipatory bail on their executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:-

i.

they shall make themselves available for interrogation by a police officer as and when required;

ii. they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
