Karan Singh v. State Of Chhattisgarh
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPC No. 206 of 2017 • Karan Singh S/o. Gujrat Singh, Aged About 59 Years R/o. Village Mudhena, Tahsil & District Mahasamund (Chhattisgarh) ---- Petitioner
Versus
1. State Of Chhattisgarh Through Secretary, Department Of Mineral Resources, Mahanadi Bhawan Mantralaya, Capital Complex, New Raipur, District Raipur (Chhattisgarh)
2. Collector, Mahasamund District Mahasamund (Chhattisgarh)
3. Director, Geology And Mining, Raipur, District Raipur (Chhattisgarh)
4. Narendra Singh, S/o. Bramha Singh, R/o. Govinda, Tahsil And District Mahasamund (Chhattisgarh) ---- Respondent For Petitioner Mr. Manoj Paranjpe and Mr. Vikram Dixit, Advocates For Respondent/State Mr. Shashank Thakur, Government Advocate Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 1/2/2017
1. Heard.
2. Challenge in this petition is to the order passed by the Director, Geology and Mining, Chhattisgarh, Raipur on 24.01.2015 dismissing the petitioner's Appeal Case No.24/2009, which, in turn, was preferred against the order dated 18.03.2009 passed by the Collector Mahasamund, cancelling the petitioner's mining
lease over the area admeasuring 0.60 Hectare bearing Khasra No.06, Village Mudhena, Tehsil and District Mahasamund..
3. Admittedly, the subject land belongs to respondent No.4 Narendra Singh and not to the petitioner, therefore, on an application filed by Narendra Singh, the subject area was excluded from the mining area allowed to the petitioner and thus, the petitioner's mining lease was reduced by 0.60 hectare.
4. It is to be seen that the original mining lease was operative from 05.03.2002 to 4.3.02012, therefore, mining lease itself having lived its life, the issue raised in the present writ petition has rendered academic.
5. In the above view of the matter, the writ petition is dismissed. Sd/- Judge (Prashant Kumar Mishra) Shyna
