The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.408/2015, registered in Police Station : Masturi, District - Bilaspur for offence punishable under Sections 420, 467, 468, 471, 120B of the IPC. 2.

Case of the prosecution, in brief, is that complainant, her sistersSmt. Shanti Bhardwaj, Smt. Usha Narmada and Smt. Sandhya Kaushik and accused Omprakash Goutam are owners of the land, area 5.90 acres situated at village Nirtu. It was further allegation that co-accused Omprakash Goutam by impersonating some other women as his sisters, Smt. Shanti Bhardwaj, Smt. Usha Narmada and Smt. Sandhya Kaushik got executed power of attorney. On the basis of said power of attorney, co-accused Omprakash Goutam sold the aforesaid land to Smt. Kaushilya Bai through registered sale

deed. Allegation against Jaymati Bai is that she impersonating herself as sister of Omprakash Goutam appeared before the Registering Authority and signed the papers and allegation against Smt. Kaushilya Bai is that she was purchaser of land in dispute. 3.

Learned counsel for the State would not dispute that similarly placed co-accused Jaymati Bai is also released on bail in MCRC No. 2027/2016 and also similarly placed other co-accused Santoshi Sahu and Dharam Singh Mansagar have been released on bail in MCRC Nos. 655/2016 and 1827/2016 respectively.

Considering the release of similarly placed co-accused persons on bail, this Court is inclined to release the applicants on bail. 5.

Accordingly, the application is allowed and the applicants are directed to be released on bail on their executing a personal bond for a sum of Rs.25,000/- each with one surety for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given to him by the said Court. Sd/- Vacation Judge (Prashant Kumar Mishra) chandra
