Heard on I.A. No.01/16, application under Section 5 of the Limitation Act for condonation of delay occurred in filing of the Cr.M.P.

On due consideration, I.A. No.01 is allowed and the delay in filing the instant Cr.M.P. is condoned. Also heard the present application filed under section 378 (3) of Cr.P.C. seeking for grant of leave to appeal against the judgment of acquittal dated 14.10.2015 passed in Criminal Case No. 942/2012.

As arguable points have been raised by the State counsel particularly referring to Paragraph-8 of the impugned judgment, the application for leave to appeal is allowed.

Leave as prayed for is granted.
