(2) The petitioner is challenging the appointment of the respondent No.4 as Rozgar Sahayak of Gram Panchayat, Dumhani, Bilaigarh, Block Kasdol, District Baloda Bazar, Bhatapara.

(3) Any order passed by the Chief Executive OfÏcer under the provisions of the MGNREGA Scheme is appealable before the concerned Collector.

(4) For the foregoing, the writ petition is disposed of with a direction that in the event, the petitioner prefers an appeal before the concerned Collector within a period of 15 days from today, the same shall be considered by the concerned Collector, in accordance with law, on its own merits, as early as possible, preferably within a period of 6 months from the date of presentation of appeal, after hearing all the concerned parties.

(5) It is made clear that this Court has not expressed any opinion on the merits of the case and the authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
