1. Heard.

2. The applicant has preferred this bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.35/2020, registered at Police Station Bilha, District: Bilaspur (C.G.) for the offence punishable under Sections 342, 376, 506 of the Indian Penal Code and under Section 4 of the protection of children from sexual offences Act, 2012.

3. The first bail application was dismissed on merits with liberty to revive the prayer after examination of the prosecutrix on 21-09-2020 in MCRC No.5838 of 2020, however, this bail application has been filed without the prosecutrix having been examined before the trial Court.

4. Considering the earlier Order, the bail application is dismissed however, the liberty reserved earlier shall remain intact.
