The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.235/2015 registered in Police Station Kansabel, District-Jashpur (C.G.) for offence punishable under sections 302, 392, 323, 34 of Indian Penal Code. 2.

As per the prosecution case, applicant and other co-accused have allegedly committed murder of Paladius Ekka, aged about 61 years by mercilessly beating him with hands and fists for considerable length of time. Case diary contains eye witness account of witnesses namely Shweta, Ronisha, Albert Ekka, Sabina, Asantiana and Ajekiyal Ekka (complainant).

Learned counsel for the applicant submits that the applicant is in jail since 27/12/2015 and he has been falsely implicated, therefore he may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the facts and circumstances of the case and also

considering the statement of eye witnesses, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
