With the consent of the learned counsel for the parties, the matter is heard finally.

The petitioner has prayed for a direction to the respondents not to pass final order in the pending departmental enquiry against him and allow

him to continue on duty considering the circular issued by the Central Government.

Shri Kesharwani, learned Standing counsel for the Union of India had earlier appeared on 13.05.2015 and was directed to seek instructions in the matter. He would report that the departmental enquiry has already come to an end and penalty of dismissal from service has been imposed on the petitioner.

In view of the above, the writ petition has been rendered infructuous. Accordingly, the writ petition is dismissed as infructuous, however, the petitioner would be at liberty to prefer an appeal against the final order passed by the Central Government and thereafter to prefer a writ petition, in accordance with law.
