1. Learned counsel for the petitioner submits that inadvertently, the order imposing interest under Section 7-Q of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 and the order imposing damages under Section 14-B of the said Act that was passed on 20-12-2001, could not be challenged and only refund was claimed, therefore, the petitioner may be allowed to withdraw this petition with liberty to challenge the said order dated 20-12-2001 in accordance with law.
2. The prayer made by learned counsel for the petitioner is just, fair and reasonable.
3. Accordingly, the petition is dismissed as withdrawn with liberty aforesaid. No order as to cost(s).
