1. The applicants have preferred this application for grant of anticipatory bail, as they apprehend their arrest in connection with Crime No.14/2020, registered in Police Station Mahila Thana, District - Durg C.G. for offence under Section 498A, 34 of

the I.P.C.

2. The applicant No.1 is the husband whereas applicant No.2 is the mother-in-law of the complainant, who was married with applicant No.1 on 18.05.2014. They are residing separately since 31.03.2015 and there appears award of maintenance in the favour of the wife. Complainant is otherwise employed as AG-III in Commercial Tax Department, Durg while the applicant No.1 is also working as Stenographer in the same department.

3. Learned State counsel and the objector would oppose the prayer for anticipatory bail.

4. Considering that the couple are residing separately since 2015 but the FIR was lodged only in the year 2020 and moreover applicant No.1 is a government servant and applicant No.2 is an elderly lady aged about 57 years, this Court is inclined to extend the benefit of anticipatory bail.

5. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicants, they shall be released on anticipatory bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (I) they shall make themselves available for interrogation by a police officer as and when required;

(ii) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
