The applicant has preferred this bail application as he has been arrested in connection with Crime No.75/2009, registered at Police Station Ramanujganj, District Balrampur-Ramanujganj (C.G.) for offence punishable under Sections 147, 149, 364, 302 & 201 of the IPC. 2.

This is the third bail application before this Court under Section 439 of the Cr.P.C. The first bail application was rejected by this Court on 24.09.2012 in M.Cr.C. No.3503/2012 on merits by a detailed order and the second bail application bearing M.Cr.C. No.3647/2013 was dismissed on 07.08.2013. It is a case of triple murder.

After hearing learned counsel for the applicant, this Court is not inclined to take any different view of the matter, because the earlier bail applications

were dismissed and this Court would not proceed to appreciate the evidence adduced by the prosecution in course of trial, because doing so may prejudice either party at the trial.

The trial Court is directed to expedite the hearing of the trial and do its best to dispose the same at the earliest.
