(2) Learned counsel appearing for the petitioner would fairly submit that the impugned order dated 08.04.2016 passed by respondent No.3 is appealable before the appellate authority

under the certified standing order, therefore, he may be permitted to prefer an appeal before the appellate authority within ten days from today.

(3) The prayer appears to be fair and reasonable. (4) The petitioner is permitted to prefer an appeal before the appellate authority. If such appeal is filed by the petitioner within a period of ten days from today, the appellate authority shall consider and decide the same in accordance with law and on its own merit preferably within a period of 45 days from the date of receipt of the appeal along with copy of this order. (5) With the aforesaid observation, the writ petition stands disposed of. No order as to cost(s).
