The present MCC has been filed seeking for restoration of MAC No. 06.03.2019 1240/2017 which got dismissed on account of peremptory order passed by this Court on 04.09.2017.

Counsel for the applicant submits that there were 3 defaults in the appeal of which he has cured 2 defaults and only one default left when the appeal stood dismissed.

Considering the entire facts and circumstances of the case, particularly taking note of the fact that the peremptory order was passed by this Court in the presence of the counsel for the appellant and also taking note of the period after which the applicant has now filed the MCC seeking for restoration, subject to the applicant depositing cost of Rs.5,000/- in the Chhattisgarh High Court Bar Association Library Fund Account No. 32749718036 and furnishing receipt of the same to the Registry of this Court within a period of 7 days from today, MAC No.1240 of 2017 shall be restored to its original number. It is made clear that if the cost is not deposited within 7 days, the order passed by this Court in the present MCC shall lose its efficacy. Sd/- (P. Sam Koshy) JUDGE Khatai
