(2) Learned counsel appearing for the State/respondents submits that the impugned order dated 09.01.2014 passed by respondent No.4 i.e. Chief Executive Officer, Janpad Panchayat, Khadganwa, District Baikunthpur Korea is appealable before respondent No.2 i.e. Collector, Korea.

(3) At this stage, learned counsel appearing for the petitioner submits that he may be permitted to prefer an appeal before respondent No.2 within a period of 15 days from today. (4) Prayer appears to be fair and reasonable.

(5) The petitioner is permitted to prefer an appeal before the respondent No.2. If such appeal is filed by the petitioner within a period of 15 days from today and, in turn, the said authority shall consider and decide the same in accordance with law and on its own merit preferably within a period of four months after hearing of both the parties from the date of receipt of appeal of the petitioner along with copy of this order.

(6) With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
