The grievance of the petitioner in the present writ petition is the action on the part of the respondents in granting promotion at a belated stage, though he was entitled for the promotion to the post of Lecturer w.e.f. 19.06.2012 onwards.

According to the petitioner, a similarly placed person namely Rajesh Nath Yogi had approached this Court vide WPS No. 4715/2018 seeking for a similar promotion from an earlier date. The writ petition was disposed of on 23.07.2018, whereby the said person was granted liberty to make a representation and the authorities were directed to decide the representation. Subsequently, the said person had been granted promotion on the post of Lecturer from 19.06.2012 onwards.

-2According to the petitioner, he also is identically placed as that of Rajesh Nath Yogi and therefore the petitioner also is entitled for being considered for promotion along with other similarly placed persons, who were granted promotion w.e.f. 16.06.2012 and also in parity with the case of Rajesh Nath Yogi, who has been recently granted promotion w.e.f. 19.06.2012.

Given the said factual matrix of the case, let the petitioner therefore move an appropriate representation to the respondent No.2, who in turn shall duly get the service records of the petitioner and compare his case along with other similarly placed persons appointed along with the petitioner and also compare the case of the petitioner in parity with the case of Rajesh Nath Yogi and an appropriate decision for grant of promotion to the petitioner be taken preferably within a period of 90 days from the date of receipt of the copy of this order. 4.

With the aforesaid observations, the present writ petition stands disposed of.
