Also heard on prayer for grant of leave to appeal. Taking into consideration the submission of learned State counsel that the circumstances proved by the prosecution from the evidence of the prosecution witnesses only point towards guilt of the respondent, we are inclined to grant leave to appeal.

Application for grant of leave to appeal is accordingly allowed. The appeal filed by the State be registered as Acquittal Appeal and be listed for further orders.
