Instant petition has been filed by the petitioner aggrieved by nonconsideration of her case for grant of time pay scale/kramonnati. 2.

It is stated that the petitioner was initially appointed as UDT on 7/05/1981. Thereafter in the year 1988 she was promoted as Head Master and Lecturer respectively and on 7/04/1999 the petitioner was promoted as Principal. It is stated that the petitioner since then is working as a Principal without getting any promotion or grant of higher pay scale and she is in stagnant position. The petitioner contends that as per the circular dated 28/04/2008 the petitioner is entitled to be considered for grant of higher pay scale/kramonnati with effect from the date she has completed 10 years of service.

Having considered the submission, the State counsel would submit that whatever claim may be decided in accordance with law.

Having considered the submission, the petitioner since has claimed that she has completed 10 years of service and is stagnant to the post of Principal from the year 1999, therefore the respondents are duty bound to examine the petitioner's claim of scale promotion under the circular dated 28/04/2008 and other applicable circular in the matter and decide the same. The petitioner is given liberty to make a representation to the respondent No.1 within a further period of three weeks from today claiming the benefit. The representation if so received shall be further decided within a further period of four months from the date of receipt of the representation by the respondent No.1. The petitioner may also attach necessary relevant documents in support of their claim. 5.
