Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 19/05/2016
1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.22/2016, registered in Police Station : Sihawa, District Dhamtari for offence under Section 304, 429/34 of the IPC and Section 135/138 (C) of the Electricity Act, 2003.
2. The applicant has allegedly erected live electrical wire in his agricultural field for protection from wild animals. One cow got trapped in the live wire and the deceased was trying to save the cow, however, in the process he also came in contact with live electrical wire and died.
3. Having considered the material available in the case diary and for the reason that the applicant is in jail since 12.3.2016 and charge sheet having been filed, this Court is inclined to release the applicant on bail.
4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
