1. Apprehending arrest in connection with Crime No. 315/2015 registered at Police Station Surajpur, Distt. Surajpur (C.G) for the offences punishable under sections 4, 6 & 10 of Chhattisgar Agriculture Cattle Preservation Act, 2004. This is second bail application. The earlier bail applciation was dismissed on 03.02.2016.

2. As per the prosecution case, an information was received that some cattle were being transported to slaughter house. As such complaint was made by one Manoj Kumar Pandey who informed the villagers that their cattle were being transported for slaughtering. Subsequently it was found that both legs of few of cattle were tied and they were being taken to be sold . At the time of incident, it was seen that while 2-3 cattle were

goaded the applicants were identified by the villagers.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case as he was not present on the spot. Reading of the earlier bail rejection order dated 03.2.2016 would show that the order was passed on merits and nothing has been substantiated before this court to consider that there is change of circumstances as the facts remained as it is. Therefore, I am not inclined to release the applicant on anticipatory bail.
