1. This appeal arises out of the judgment of conviction and order of sentence dated 22.01.2020 passed by the Special Judge, Protection of Children from Sexual Offences Act, 2012, Fast Track Court, Kabirdham, C.G. in Special Sessions Case No. 41/2018, whereby and whereunder the appellant stands convicted and sentenced as under:- Conviction Sentence Under Section 363 of Indian Penal Code Rigorous Imprisonment for five years and fine of Rs.500/-, in default of payment of fine amount to undergo further rigorous imprisonment for one month Under Section 366 of Indian Penal Code Rigorous Imprisonment for five years and fine of Rs.500/-, in default of payment of fine amount to undergo further rigorous

imprisonment for one month Under Section 6 of the POCSO Act Rigorous Imprisonment for ten years and fine of Rs.5,000/-, in default of payment of fine amount to undergo further rigorous imprisonment for two months

2. The matter is listed for order on default as the accused/appellant has already filed another appeal i.e. CRA No.277 of 2020 against the impugned judgment which is pending before this Court.

3. In view of above, counsel for the appellant seeks to withdraw this present appeal.
