This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.

The applicants have been arrested in connection with Crime No. 37/2019 registered at Police Station- Khallari, District- Mahasamund (C.G.) for the offence punishable under Section 34 (2) of CG Excise Act. 3.

Argument heard.

Case of the prosecution, in brief is that on 13.02.2019, 40 bulk liters of hand made country liquor has been seized from the joint possession of the applicants. 5.

Counsel for the State submits that one another criminal case under the Excise Act has been registered against the applicant No.1. No Antecedent reported against the applicant No.2.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if the applicant No.1 furnishes two solvent sureties for a sum of Rs. 25,000/- along with a personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned Trial Court with condition that he will not involve in any crime in future, he will appear before the Trial Court at 11:00 am as and when directed till trial and he would cooperate during the trial, he shall be released on bail. If the applicant No.2 furnishes one solvent surety for a sum of Rs. 25,000/- along with one personal bond of Rs. 25,000/- to the satisfaction of the trial Court concerned, he be released on bail.
