(2) Learned counsel appearing for the petitioner submits that he may be permitted to withdraw the instant writ petition with liberty to prefer an appeal before the appellate authority and direction may be issued to the appellate authority to decide the same, expeditiously.

(3) Prayer appears to be fair and reasonable.

(4) Accordingly, the petitioner is permitted to file an appeal before the appellate authority. If such appeal is filed by the petitioner before the appellate authority, the appellate authority shall consider and decide the same on its own merit and in accordance with law expeditiously.
