1. In this batch of writ petitions filed under Article 226 of the Constitution of India, the petitioners have mainly sought the following common relief(s) :
"10.1 The Hon'ble High Court may kindly be pleased to call for the entire records pertaining to the case of petitioner for its kind perusal ; 10.2 The Hon'ble High Court may kindly be pleased to issue writ or writs, order or orders to the Respondent authorities concerned to take up with the respondent No.4 for refunding the amount deposited with them in the form of "Recurring Deposit" or other modes, in the interest of justice ; 10.3 The Hon'ble Court may kindly be pleased to direct the respondent (State) not to take any legal action against the petitioner till the pendency of present petition, in the interest of justice; 10.4 Any other relief, this Hon'ble Court deem fit and proper may also kindly be granted to the petitioner, in the interest of justice."
2. The facts of the case are that the petitioners have worked as Agents and also deposited certain amounts with respondent No.4 Panna Credit and Thrift Multi State Cooperative Society Limited. The averments made in the petitions are that after the specified period of time, the money which was assured to be returned with high value was not returned, thereby respondent No.4 Cooperative Society Ltd has committed forgery and fraud and ultimately fled away from the State of Chhattisgarh.
3. In sum and substance, the prayer made in all these writ petitions is that the authorities of State as well as the Union of India be directed to chase respondent No.4 to recover the amounts deposited by the petitioners.

A perusal of the documents filed along-with the petitions would show that the petitioners worked as Agents for Respondent No.4 and collected amount from different persons and contends that it was deposited with Respondent No.4. The petitioners also claim that they too have deposited certain money with respondent no.4. Without going into the merits of the case when the averments are considered together with prayer it would show that there is no privity of contract between the petitioners and respondent No.4. If respondent No.4 has failed to pay the amount, in such a case, the private contract between the petitioners and respondent no.4 cannot be enforced by issuance of writ and in such furtherance, the State or Union of India cannot be directed to chase respondent no.4 to recover the money.
There is nothing on record to suggest that the State or Union of India have indemnified the depositors or Agents that in case certain default is made by the Company to pay back the amount it would be the responsibility of State to get it recovered. Further the State cannot be directed to open the treasury, the tax payers money to make good the default of the party, who has committed fraud or forgery.
5. Accordingly, the petitions are devoid of merits and are dismissed.
