1. Heard.
2. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 11.07.2020 in connection with Crime No.140/2020 registered at Police Station Lailunga, District Raigarh (CG) for the offence punishable under Sections 395, 412 of I.P.C.
3. As per the prosecution case, on 03.07.2020 the applicant along with coaccused have looted around Rs.43000/- from one Subhash Das Mahant, who was working in Spandana Sphoorty Financial Company, Gharghoda.
4. Learned counsel for the applicant submits that the other co-accused person has been enlarged on bail by the co-ordinate Bench of this Court and there is no identification and no recovery has been made from the present applicant, therefore, the applicant may be released on bail.
5. Learned State counsel do not dispute the fact that the other co-accused has been enlarged on bail by the co-ordinate Bench and no recovery has been made from the present applicant.
6. Considering the nature of submission that the other co-accused has been enlarged on bail by the co-ordinate Bench, I am inclined to release the applicant on bail.
7. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court.
