Hon'ble The Vacation Judge Order On Board 18/05/2015

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 162/2014 registered in police station Amanaka, district Raipur, Chhattisgarh for offence punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.

2. One Khedia Bai who was the beneficiary of amount of compensation under the Land Acquisition Act, taking the benefit of death of Khedia Bai, coaccused Lakhan Lal Sahu (Sarpanch), Devendra Sahu and the present applicant hatched a conspiracy to withdraw the amount and in furtherance of that they allegedly concocted the family ration card and other documents in the name of Khedia Bai and thereafter withdrew the amount of Rs. 4,03,166/- from the Chhattisgarh Grih Nirman Mandal.

3. Learned counsel for the applicant would submit that co-accused Lakhan Lal

Sahu (Sarpanch) against whom allegation of forging the ration card is levelled, has already been released on bail in M. Cr. C. No. 1046/2015 and similarly co-accused Devendra Sahu has also been released on bail in M.Cr.C. No. 1458/2015.

4. Considering the facts and circumstances of the case and the fact that the applicant is in jail since 17.4.2015, this Court is inclined to release him on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs. 25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
