The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 546/2015 (wrongly mentioned in rejection order as year 2016 registered in Police Station Kotwali (As per FIR) (Chowki Rampur), Korba (C.G.) for offence punishable under Section 420, 467, 468, 471, 120(B), 201 read with Section 34 of IPC (As per charge sheet).

As per the prosecution case the applicant in connivance with Vinod Khande and Kapil issued different appointment letters for the post of Data Entry Operator and against this applicant allegation are that he typed such appointment letters. Such appointment letters were issued after obtaining amount from different persons.

Learned counsel for the applicant would submit that no evidence is

available on record to prove the fact that present applicant is involved anyway in the offence. He further submits that only on the basis of memorandum of the co-accused applicant has been inculpated. He submits that charge sheet has been filed, no further evidence is required, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail and would submit that in similar circumstances bail of the other co-accused has been dismissed by the coordinate bench of this court in M.Cr.C. No.1566/2016 on 17/03/2016.

I have perused the case diary and the documents. Considering the fact that allegation levelled against this applicant that he along with other co-accused after receiving the amount has issued forged appointment letter to various persons by accepting huge amount. Taking into such fact and the way the offence has been committed and further bail of the other co-accused has been dismissed by the coordinate bench of this court and also considering the documents available on record, I am not inclined to release the applicant on bail.
