Hon'ble Justice Shri Gautam Chourdiya Order on Board 21/05/2020 1) This appeal is filed under section 374(2) of Code of Criminal Procedure, 1973 against the judgment of conviction and order of sentence dated 23/09/2002 passed by Special Judge (ST/SC (Prevention of Atrocities Act, 1989) Raipur (C.G.) in Special Session Case No. 95/2001; whereby the appellant stands convicted and sentenced as under:- Conviction Sentence U/s. 452 of Indian Penal Code (in short "IPC") R.I. for 1 year & fine of Rs. 500/- in default of fine additional R.I. for 2 months.

U/s/ 3(1)(XI) of SC/ST (Prevention of Atrocities) Act, R.I. for 6 months & fine of Rs.

500/- in default of fine additional R.I. for 2 months.

2) Learned counsel for the appellant as well as the State respondent submit that during pendency of this appeal, the sole appellant Mangal Das S/o Hira Das Manikpuri has died on 22/01/2020.

3) As per report received from Special Judge Atrocities Raipur dated 12/03/2020 the appellant has died on 22/01/2020. Alongwith the said report death certificate, certificate issued by Sarpanch of Gram Panchayat Dandesara and report from Police Station Kurud certifying death of the appellant on 22/01/2020 are enclosed. The aforesaid documents are taken on record. 4) In this case, no any application has been filed by the LRs of the deceased appellant for prosecuting this appeal.
