This is the third bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.165/2016 registered at Police Station- Manendragarh, District Koriya (C.G.) for the offence punishable under Sections 363, 366, 342, 376(2)(J) of I.P.C. and 4 & 6 of POCSO Act, 2012. 2.

Learned counsel for the applicant submits that as per the information received all the witnesses have been examined except one I.O. He submits that since the I.O. is not coming, therefore, the applicant is unnecessarily lodged in jail; therefore, he may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Considering the fact that all the witnesses have been examined except one and the trial appears to be at the fag end, I am not inclined to enlarge the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is rejected. However, the trial Court is directed to expedite the trial. Sd/- (Goutam Bhaduri) Judge Ashok
