Learned counsel for the petitioner seeks permission of the Court to withdraw the writ petition with liberty to prefer an appeal under Rule 23 of Chhattisgarh Civil Services (Classification, Control & Appeal) Rules, 1966.

Accordingly, the writ petition is dismissed as withdrawn. If the petitioner prefers an appeal within a period of 15 days from today, the Appellate Authority shall consider and decide the appeal, in accordance with law, on its own merits, at the earliest, preferably within a period of 3 months from the date of submission.
