1. Heard.
2. This is an application filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail to the applicants, who are apprehending their arrest in connection with Crime No.17/2020, registered at Police Station Somni,
District Rajnandgaon (CG) for the offence punishable under Sections 498-A & 306 of IPC.
3. Applicant No.1 is the husband, applicant No.2 is the father-inlaw and applicant No.3 is the mother-in-law of the deceased, who committed suicide by jumping under running train on 23.9.2019.
4. As informed by learned counsel for the State, the case diary reveals that the applicants were not treating the deceased well by commenting upon the quality of food prepared by her and for not doing the daily household chores properly.
5. Admittedly, there is no allegation of demand of dowry or cruelty concerning such demand. The allegation revolves around daily household chores. There does not appear to be any serious immediate cause or ill-treatment, which compelled the deceased to commit suicide on the fateful day.
6. Considering the nature of allegations, I am of the opinion that present is a fit case to extend the benefit of Section 438 of Cr.P.C. to the applicants.
7. Accordingly, the application is allowed and it is directed that in the event of arrest of these applicants, they shall be released on anticipatory bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety each in the like sum to the satisfaction of the Arresting OfÏcer with the following conditions :-
