Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 27/02/201 (1) Learned counsel appearing for the petitioner would submit that the order of remand has been passed by the Commissioner to the Collector on 22.10.2013 for deciding the case after giving opportunity of hearing to both the parties. The Collector allowed the petitioner's application vide order dated 9.9.2015 directing the Sub Divisional Officer to restore the possession of the suit land to the petitioner, however, the after lapse of more than two years, Sub Divisional Officer has not passed any order in this regard and, therefore, the SDO, Dongargarh may be directed to decide the revenue case expeditiously.
To which, counsel for the State has no objection. (2) Be that as it may, since the petitioner's revenue case is pending since last more than two years, Sub Divisional Officer, Dongargarh is directed to consider and decide the same expeditiously preferably within a period of three months from the date of receipt of copy of this order.
(3) With the aforesaid observations, the writ petition stands finally disposed of. However, the Collector, Raipur is directed to ensure that the revenue cases are disposed of expeditiously and should not remain pending for long time like the present case.
