Petitioner would pray for a direction to the respondent to consider its representation No.PIL/CHP/Excise/2016-17 dated 28-12-2016 by which the petitioner is seeking indulgence of the Department to permit the petitioner to pay the outstanding amount of central excise duty by way of installment.

Learned counsel appearing for the respondent would submit, at the outset, that the Department shall decide the representation of the petitioner at the earliest.

In view of the statement made, nothing remains in this petition for adjudication. Let the Department decide the representation of the petitioner within a period of one month, in accordance with law and on its own merits.

If the petitioner so desires, the respondent may also provide opportunity of hearing to the petitioner.
