Agrawal Order On Board 05/10/2017 (1) This writ petition has been filed by the petitioner herein merely against the private company i.e. respondent No.5 alleging that respondent No.5 is illegally constructing bridge and railway line over the land of the petitioner.

(2) Learned counsel appearing for the petitioner would submit that the action of respondent No.5 is arbitrary and contrary to law. (3) The main dispute of the petitioner is that respondent No.5 is

illegally constructing bridge and railway line over his land. Since respondent No.5 is a private company and the instant writ petition as framed and filed against the private company is not maintainable. Even otherwise, I am not inclined to entertain the instant writ petition as the instant dispute is of civil nature which can be considered and decided before the jurisdictional civil court. However, the petitioner is at liberty to approach before the jurisdictional civil court for redressal of his grievances.

(4) Consequently, the writ petition deserves to be and is accordingly dismissed.
